Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the 369 Wallet mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Alpsoft Inc. ("Company", "we", "us", or "our").
2. Description of Service
369 Wallet is a self-custody cryptocurrency wallet application that allows users to manage digital assets across multiple blockchain networks, including but not limited to Bitcoin, Ethereum, Solana, BNB Smart Chain, Polygon, Arbitrum, Avalanche, Optimism, Base, XRP Ledger, and Tron. The App provides features such as sending, receiving, and swapping cryptocurrency tokens.
3. Self-Custody and User Responsibility
369 Wallet is a non-custodial wallet. This means:
- You are solely responsible for safeguarding your seed phrase (mnemonic recovery phrase), private keys, and any passwords used to access the App.
- We do not store, have access to, or have the ability to recover your seed phrase or private keys. If you lose them, your funds cannot be recovered.
- You are fully responsible for all transactions initiated through the App. Blockchain transactions are irreversible once confirmed.
- You are responsible for ensuring the accuracy of wallet addresses and transaction details before confirming any transaction.
4. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App. By using 369 Wallet, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
5. Prohibited Uses
You agree not to use the App to:
- Engage in any activity that violates applicable laws or regulations, including anti-money laundering (AML) and counter-terrorism financing (CTF) laws.
- Conduct transactions involving proceeds of illegal activities.
- Attempt to interfere with, compromise, or disrupt the App or its underlying infrastructure.
- Use the App in any manner that could damage, disable, or impair the service.
6. Third-Party Services
The App integrates with third-party services such as CoinGecko for price data and third-party DEX protocols for cross-chain swaps. We are not responsible for the availability, accuracy, or reliability of these third-party services. Your use of third-party services is subject to their respective terms and conditions.
7. Intellectual Property
All content, trademarks, logos, and intellectual property displayed in the App are the property of Alpsoft Inc. or its licensors. You may not copy, modify, distribute, or create derivative works based on the App without prior written consent.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO REPRESENTATIONS REGARDING THE ACCURACY OR COMPLETENESS OF ANY PRICE DATA, TRANSACTION INFORMATION, OR OTHER CONTENT PROVIDED THROUGH THE APP.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPSOFT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, DATA, OR PROFITS, ARISING FROM YOUR USE OF THE APP. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR WALLET, TRANSACTION ERRORS, OR BLOCKCHAIN NETWORK FAILURES.
10. Risk Acknowledgment
By using the App, you acknowledge that:
- Cryptocurrency markets are highly volatile and you may lose some or all of your investment.
- Blockchain transactions are irreversible. Sending funds to an incorrect address may result in permanent loss.
- Regulatory changes may affect the availability or legality of certain cryptocurrencies or services in your jurisdiction.
- Smart contract interactions carry inherent risks, including bugs and vulnerabilities.
11. No Financial Advice
Nothing in the App or on our website constitutes financial, investment, tax, or legal advice. The App is a tool for managing cryptocurrency assets and does not recommend, endorse, or suggest any particular cryptocurrency, token, or investment strategy. You should consult a qualified financial advisor before making any investment decisions. Any price data displayed in the App is for informational purposes only and should not be relied upon as the sole basis for any financial decision.
12. Regulatory Compliance
You are solely responsible for complying with all applicable laws and regulations in your jurisdiction related to the use of cryptocurrency, including but not limited to tax reporting obligations, capital controls, and financial regulations. The availability of the App does not constitute an offer or solicitation in any jurisdiction where such use would be prohibited by law. We make no representations that the App is appropriate or available for use in all jurisdictions.
13. Forks, Airdrops, and Network Events
We are not responsible for the management, support, or claiming of tokens resulting from blockchain forks, airdrops, or other network events. The App may not support all forked chains or airdropped tokens. Any decision to support such assets is at our sole discretion.
14. Indemnification
You agree to indemnify, defend, and hold harmless Alpsoft Inc., its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.
15. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved through the following process:
- Informal Resolution: The parties shall first attempt to resolve any dispute informally by contacting us at support@369wallet.xyz. We will attempt to resolve the dispute within 30 days.
- Arbitration: If informal resolution fails, any dispute shall be finally resolved by arbitration administered by the Korean Commercial Arbitration Board (KCAB) in accordance with its rules. The arbitration shall take place in Seoul, Republic of Korea. The language of arbitration shall be Korean or English.
- Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of any class, consolidated, or representative action.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Alpsoft Inc. regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.
18. Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website and within the App. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
19. Termination
Since 369 Wallet is a non-custodial wallet, you may stop using the App at any time. Your assets remain accessible through your seed phrase on any compatible wallet. We reserve the right to discontinue the App or any of its features at any time without prior notice.
20. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
